{"id":25106794,"date":"2022-11-07T16:05:28","date_gmt":"2022-11-07T15:05:28","guid":{"rendered":"https:\/\/labidikm.net\/?p=25106794"},"modified":"2025-03-08T21:42:45","modified_gmt":"2025-03-08T20:42:45","slug":"human-rights-between-presence-and-forgetfulness","status":"publish","type":"post","link":"https:\/\/labidikm.net\/en\/human-rights-between-presence-and-forgetfulness\/","title":{"rendered":"Human Rights: Between Presence and Forgetfulness"},"content":{"rendered":"<h2 data-start=\"235\" data-end=\"290\"><strong data-start=\"239\" data-end=\"290\">Human Rights Between Presence and Forgetfulness<\/strong><\/h2>\n<p data-start=\"292\" data-end=\"672\">After World War II and the atrocities that nearly wiped out humanity, the United Nations decided to draft a global law, which it considered an international charter to preserve <a href=\"https:\/\/en.wikipedia.org\/wiki\/Human_rights\" target=\"_blank\" rel=\"noopener\">human rights<\/a> as an individual within the human collective. The drafting of this charter began on <strong data-start=\"566\" data-end=\"587\">December 10, 1948<\/strong>, in <strong data-start=\"592\" data-end=\"601\">Paris<\/strong> and was completed in <strong data-start=\"623\" data-end=\"631\">1966<\/strong>, finally coming into effect in <strong data-start=\"663\" data-end=\"671\">1976<\/strong>.<\/p>\n<p data-start=\"674\" data-end=\"999\">Nearly <strong data-start=\"681\" data-end=\"699\">half a century<\/strong> has passed since the implementation of this charter, which consists of <strong data-start=\"771\" data-end=\"786\">30 articles<\/strong> aimed at protecting individuals and their rights. This leads us to question how well this law has been applied, both in countries that claim to uphold this project and in those that have ratified its provisions.<\/p>\n<p data-start=\"1001\" data-end=\"1348\">Of course, it is important to note that <strong data-start=\"1041\" data-end=\"1163\">many countries have not ratified the charter at all, while others have only accepted certain parts and rejected others<\/strong>. Additionally, some countries that have formally ratified the charter do not actually implement its principles\u2014including those that <strong data-start=\"1296\" data-end=\"1347\">claim to be the ideal defenders of human rights<\/strong>.<\/p>\n<h3 data-start=\"1350\" data-end=\"1400\"><strong data-start=\"1354\" data-end=\"1400\">The Reality of Human Rights Implementation<\/strong><\/h3>\n<p data-start=\"1401\" data-end=\"1727\">We know that <strong data-start=\"1414\" data-end=\"1548\">any law in the world, no matter how clear, can be manipulated, misinterpreted, or ignored based on interests and political agendas<\/strong>. Laws can be deliberately neglected when they do not serve a particular cause or, conversely, <strong data-start=\"1643\" data-end=\"1667\">selectively enforced<\/strong> for ulterior motives. There are countless examples of this.<\/p>\n<p data-start=\"1729\" data-end=\"2072\"><strong data-start=\"1729\" data-end=\"1827\">Western countries, in particular, are known to exploit the concept of human rights selectively<\/strong>, using it as a political tool. They <strong data-start=\"1864\" data-end=\"1923\">criticize nations that oppose their political interests<\/strong> while <strong data-start=\"1930\" data-end=\"1990\">ignoring human rights violations in their allied nations<\/strong>\u2014especially when these allies have strategic political or economic ties with them.<\/p>\n<p data-start=\"2074\" data-end=\"2431\">For example, <strong data-start=\"2087\" data-end=\"2200\">Western countries previously praised Iraq\u2019s human rights record under Saddam Hussein during the Iran-Iraq war<\/strong>, simply because Saddam served their interests by fighting Iran. However, the moment Iraq became a threat to their Gulf allies, they began <strong data-start=\"2339\" data-end=\"2396\">raising the banner of human rights violations in Iraq<\/strong> as justification for intervention.<\/p>\n<h3 data-start=\"2433\" data-end=\"2473\"><strong data-start=\"2437\" data-end=\"2473\">Double Standards in Human Rights<\/strong><\/h3>\n<p data-start=\"2474\" data-end=\"2814\">One of the clearest examples is how <strong data-start=\"2510\" data-end=\"2621\">Western powers turn a blind eye to human rights violations in oil-rich Gulf states, especially Saudi Arabia<\/strong>. Despite the well-documented human rights abuses in these countries, Western governments have rarely condemned them, <strong data-start=\"2739\" data-end=\"2813\">choosing instead to maintain their economic and political partnerships<\/strong>.<\/p>\n<p data-start=\"2816\" data-end=\"3149\">The same <strong data-start=\"2825\" data-end=\"2845\">double standards<\/strong> apply when it comes to <strong data-start=\"2869\" data-end=\"2897\">Palestinian human rights<\/strong>. The <strong data-start=\"2903\" data-end=\"3027\">West has, on multiple occasions, ignored or even participated in violations of Palestinian rights at the hands of Israel<\/strong>. This is done without shame, even while these same countries claim to champion <strong data-start=\"3107\" data-end=\"3148\">justice, democracy, and human dignity<\/strong>.<\/p>\n<h3 data-start=\"3151\" data-end=\"3203\"><strong data-start=\"3155\" data-end=\"3203\">The True Agenda Behind Human Rights Rhetoric<\/strong><\/h3>\n<p data-start=\"3204\" data-end=\"3691\">In reality, <strong data-start=\"3216\" data-end=\"3294\">Western powers only defend human rights when it serves their own interests<\/strong>. The hypocrisy became even more evident during the <strong data-start=\"3346\" data-end=\"3368\">Russia-Ukraine war<\/strong>, which was instigated by the <strong data-start=\"3398\" data-end=\"3481\">United States to drag both East and West into a costly and unnecessary conflict<\/strong>. This war is <strong data-start=\"3495\" data-end=\"3529\">not about democracy or justice<\/strong>, but rather about <strong data-start=\"3548\" data-end=\"3583\">U.S. ambitions to weaken Russia<\/strong>. Today, we are witnessing the consequences: <strong data-start=\"3628\" data-end=\"3690\">economic collapse and hardship for people across the world<\/strong>.<\/p>\n<h3 data-start=\"124\" data-end=\"182\"><strong data-start=\"127\" data-end=\"182\">The Universal Declaration of Human Rights: A Review<\/strong><\/h3>\n<p data-start=\"183\" data-end=\"574\">Putting politics aside and focusing solely on <strong data-start=\"229\" data-end=\"256\">human rights violations<\/strong>, which are numerous, we want to analyze the <strong data-start=\"301\" data-end=\"349\">Universal Declaration of Human Rights (UDHR)<\/strong>. This declaration is considered <strong data-start=\"382\" data-end=\"431\">one of humanity\u2019s greatest legal achievements<\/strong>, though it remains <strong data-start=\"451\" data-end=\"465\">incomplete<\/strong> and should be reviewed and updated based on the <strong data-start=\"514\" data-end=\"573\">evolution of human consciousness over the past 50 years<\/strong>.<\/p>\n<p data-start=\"576\" data-end=\"1034\">The <strong data-start=\"580\" data-end=\"595\">30 articles<\/strong> of the declaration were appropriate for their time and were seen as a remarkable achievement in legal history. However, <strong data-start=\"716\" data-end=\"771\">unfortunately, they have not been properly enforced<\/strong>. Additionally, these laws <strong data-start=\"798\" data-end=\"816\">are not sacred<\/strong>, and they must be <strong data-start=\"835\" data-end=\"859\">revised and improved<\/strong> in accordance with the <strong data-start=\"883\" data-end=\"924\">current understanding of human rights<\/strong>. Most importantly, <strong data-start=\"944\" data-end=\"1033\">they should be applied universally without double standards or political manipulation<\/strong>.<\/p>\n<p data-start=\"1036\" data-end=\"1402\">If the <strong data-start=\"1043\" data-end=\"1121\">UDHR were applied as it is today to all of humanity without discrimination<\/strong>, it would be the <strong data-start=\"1139\" data-end=\"1174\">greatest achievement in history<\/strong>. However, we also <strong data-start=\"1193\" data-end=\"1239\">need to update and refine this declaration<\/strong> to <strong data-start=\"1243\" data-end=\"1290\">adapt it to modern challenges and to ensure<\/strong> that <strong data-start=\"1296\" data-end=\"1303\">all<\/strong> human beings\u2014regardless of their <strong data-start=\"1337\" data-end=\"1381\">nationality, ethnicity, or social status<\/strong>\u2014are treated equally.<\/p>\n<p data-start=\"1404\" data-end=\"1647\">Whether a person is in the <strong data-start=\"1431\" data-end=\"1535\">jungles of Africa, the deserts of Australia, the mountains of South America, or the cities of Europe<\/strong>, <strong data-start=\"1537\" data-end=\"1574\">they are first and foremost human<\/strong>. Their fundamental rights should not depend on their <strong data-start=\"1628\" data-end=\"1646\">place of birth<\/strong>.<\/p>\n<h3 data-start=\"1654\" data-end=\"1695\"><strong data-start=\"1657\" data-end=\"1695\">Examining the Articles of the UDHR<\/strong><\/h3>\n<p data-start=\"1696\" data-end=\"1893\">In this article, we will <strong data-start=\"1721\" data-end=\"1793\">go through the articles of the Universal Declaration of Human Rights<\/strong> one by one. Many people <strong data-start=\"1818\" data-end=\"1852\">have heard of this declaration<\/strong>, but <strong data-start=\"1858\" data-end=\"1891\">few actually know its content<\/strong>.<\/p>\n<p data-start=\"1895\" data-end=\"2056\">We will <strong data-start=\"1903\" data-end=\"1947\">analyze which rights are actually upheld<\/strong>, which ones are <strong data-start=\"1964\" data-end=\"1975\">ignored<\/strong>, and which ones need <strong data-start=\"1997\" data-end=\"2009\">revision<\/strong> to align with today\u2019s human rights principles.<\/p>\n<p data-start=\"2058\" data-end=\"2260\">Moreover, when we <strong data-start=\"2076\" data-end=\"2133\">discuss human rights, we must focus on the individual<\/strong> as an <strong data-start=\"2140\" data-end=\"2162\">independent entity<\/strong>, regardless of their <strong data-start=\"2184\" data-end=\"2258\">gender, religion, political beliefs, nationality, or social background<\/strong>.<\/p>\n<p data-start=\"2262\" data-end=\"2343\">The individual, as a person, must be <strong data-start=\"2299\" data-end=\"2342\">treated equally under all circumstances<\/strong>.<\/p>\n<blockquote>\n<p data-start=\"2350\" data-end=\"2394\"><strong>Article 1: The Principle of Equality<\/strong><\/p>\n<p data-start=\"2395\" data-end=\"2571\"><strong data-start=\"2395\" data-end=\"2571\">&#8220;All human beings are born free and equal in dignity and rights. They are endowed with reason and conscience and should act towards one another in a spirit of brotherhood.&#8221;<\/strong><\/p>\n<\/blockquote>\n<p data-start=\"2573\" data-end=\"2721\">This article represents <strong data-start=\"2597\" data-end=\"2618\">an absolute truth<\/strong> that should be <strong data-start=\"2634\" data-end=\"2675\">universally accepted without question<\/strong>. It requires <strong data-start=\"2689\" data-end=\"2720\">no interpretation or debate<\/strong>.<\/p>\n<p data-start=\"2723\" data-end=\"3023\">However, what should be done about those who <strong data-start=\"2768\" data-end=\"2804\">refuse to acknowledge this right<\/strong>? Here, we are <strong data-start=\"2819\" data-end=\"2857\">not just talking about individuals<\/strong> but about <strong data-start=\"2868\" data-end=\"3022\">entire ideologies and religions\u2014especially the Abrahamic religions\u2014that consider non-believers as inferior, misguided, or even deserving of punishment<\/strong>.<\/p>\n<p data-start=\"3025\" data-end=\"3180\">How do we deal with <strong data-start=\"3045\" data-end=\"3087\">ideologies that promote discrimination<\/strong> between men and women, claiming that <strong data-start=\"3125\" data-end=\"3178\">women have less dignity and fewer rights than men<\/strong>?<\/p>\n<p data-start=\"3182\" data-end=\"3324\">How should we confront those <strong data-start=\"3211\" data-end=\"3264\">who openly oppose the principle of human equality<\/strong>, whether on the basis of <strong data-start=\"3290\" data-end=\"3323\">gender, ethnicity, or beliefs<\/strong>?<\/p>\n<p data-start=\"3326\" data-end=\"3627\">Even though <strong data-start=\"3338\" data-end=\"3375\">Article 1 appears nearly flawless<\/strong>, there is a small <strong data-start=\"3394\" data-end=\"3406\">loophole<\/strong>: It <strong data-start=\"3411\" data-end=\"3483\">ties freedom, equality, dignity, and rights to reason and conscience<\/strong>. However, we know that <strong data-start=\"3507\" data-end=\"3574\">some individuals are born with mental or emotional disabilities<\/strong>, or they may develop such conditions later in life.<\/p>\n<p data-start=\"3629\" data-end=\"3713\"><strong data-start=\"3629\" data-end=\"3712\">Does this mean they are not entitled to freedom, equality, dignity, and rights?<\/strong><\/p>\n<p data-start=\"3715\" data-end=\"3875\">This article <strong data-start=\"3728\" data-end=\"3749\">should be amended<\/strong> to state that <strong data-start=\"3764\" data-end=\"3874\">all humans, regardless of their mental or emotional condition, are entitled to the same fundamental rights<\/strong>.<\/p>\n<blockquote><p><strong data-start=\"3886\" data-end=\"3919\">Article 2: Non-Discrimination<\/strong><\/p>\n<p><strong data-start=\"3920\" data-end=\"4176\">&#8220;Everyone is entitled to all the rights and freedoms set forth in this Declaration, without distinction of any kind, such as race, color, sex, language, religion, political or other opinion, national or social origin, property, birth, or other status.&#8221;<\/strong><\/p><\/blockquote>\n<p>This article reaffirms that <strong data-start=\"4206\" data-end=\"4261\">all humans should be treated equally under the UDHR<\/strong>. However, <strong data-start=\"4272\" data-end=\"4307\">this principle must be enforced<\/strong> so that <strong data-start=\"4316\" data-end=\"4351\">everyone enjoys the same rights<\/strong>, without exceptions.<\/p>\n<blockquote>\n<p data-start=\"4379\" data-end=\"4438\"><strong data-start=\"4383\" data-end=\"4438\">Article 3: The Right to Life, Liberty, and Security<\/strong><\/p>\n<p><strong data-start=\"4439\" data-end=\"4509\">&#8220;Everyone has the right to life, liberty, and security of person.&#8221;<\/strong><\/p><\/blockquote>\n<p>Every human being <strong data-start=\"4529\" data-end=\"4570\">has the absolute right to live freely<\/strong>. Any attempt to <strong data-start=\"4587\" data-end=\"4682\">deprive a person of life\u2014whether through war or legal execution\u2014is a crime against humanity<\/strong>.<\/p>\n<p>This means that <strong data-start=\"4701\" data-end=\"4781\">the death penalty and all forms of war are fundamentally inhumane and unjust<\/strong>. <strong data-start=\"4783\" data-end=\"4843\">How can any entity claim the right to take a human life?<\/strong><\/p>\n<p>Furthermore, <strong data-start=\"4858\" data-end=\"4905\">liberty is just as important as life itself<\/strong>. Denying a person their freedom is <strong data-start=\"4941\" data-end=\"5002\">equivalent to killing them while they are still breathing<\/strong>.<\/p>\n<p>A person without freedom is <strong data-start=\"5034\" data-end=\"5058\">a slave, not a human<\/strong>.<\/p>\n<p>Freedom, as stated in this article, must include <strong data-start=\"5110\" data-end=\"5133\">all aspects of life<\/strong>: freedom of <strong data-start=\"5146\" data-end=\"5200\">movement, residence, thought, work, and expression<\/strong>. However, <strong data-start=\"5211\" data-end=\"5266\">freedom must not infringe upon the rights of others<\/strong>.<\/p>\n<p>The principle of <strong data-start=\"5286\" data-end=\"5324\">freedom is built on responsibility<\/strong>. Just as freedom is <strong data-start=\"5345\" data-end=\"5413\">granted to an individual, they must not take it away from others<\/strong>.<\/p>\n<p>Denying someone their <strong data-start=\"5438\" data-end=\"5486\">right to freedom is a crime against humanity<\/strong>.<\/p>\n<blockquote>\n<p data-start=\"5494\" data-end=\"5539\"><strong data-start=\"5498\" data-end=\"5539\">Article 4: The Prohibition of Slavery<\/strong><\/p>\n<p><strong data-start=\"5540\" data-end=\"5659\">&#8220;No one shall be held in slavery or servitude; slavery and the slave trade shall be prohibited in all their forms.&#8221;<\/strong><\/p><\/blockquote>\n<p>This article is <strong data-start=\"5677\" data-end=\"5692\">fundamental<\/strong>, yet <strong data-start=\"5698\" data-end=\"5741\">slavery still exists in different forms<\/strong> today. It may not always be <strong data-start=\"5770\" data-end=\"5794\">physical enslavement<\/strong>, but <strong data-start=\"5800\" data-end=\"5851\">mental and psychological enslavement also exist<\/strong>.<\/p>\n<p>For example, many individuals <strong data-start=\"5884\" data-end=\"5980\">experience forms of servitude within their own families, workplaces, and social environments<\/strong>.<\/p>\n<p>The fight against <strong data-start=\"6001\" data-end=\"6019\">modern slavery<\/strong> must extend beyond <strong data-start=\"6039\" data-end=\"6071\">physical ownership of humans<\/strong> to include <strong data-start=\"6083\" data-end=\"6137\">any system that deprives people of their free will<\/strong>.<\/p>\n<p><strong data-start=\"6140\" data-end=\"6217\">Even today, slavery is still legally practiced in some parts of the world<\/strong>. In <strong data-start=\"6222\" data-end=\"6236\">Mauritania<\/strong>, for instance, traditional forms of slavery persist despite official bans.<\/p>\n<p>Moreover, <strong data-start=\"6323\" data-end=\"6370\">many jobs around the world resemble slavery<\/strong>\u2014with workers receiving <strong data-start=\"6394\" data-end=\"6487\">insufficient wages, working under abusive conditions, and being denied basic human rights<\/strong>.<\/p>\n<p>Although <strong data-start=\"6499\" data-end=\"6530\">Article 4 prohibits slavery<\/strong>, it does <strong data-start=\"6540\" data-end=\"6601\">not go far enough in addressing modern forms of servitude<\/strong>.<\/p>\n<blockquote>\n<p data-start=\"6609\" data-end=\"6672\"><strong data-start=\"6613\" data-end=\"6672\">Article 5: Protection from Torture and Cruel Punishment<\/strong><\/p>\n<p><strong data-start=\"6673\" data-end=\"6775\">&#8220;No one shall be subjected to torture or to cruel, inhuman, or degrading treatment or punishment.&#8221;<\/strong><\/p><\/blockquote>\n<p data-start=\"6777\" data-end=\"6911\">This article raises a <strong data-start=\"6799\" data-end=\"6823\">fundamental question<\/strong>: <strong data-start=\"6825\" data-end=\"6911\">What gives anyone the right to physically or emotionally harm another human being?<\/strong><\/p>\n<p data-start=\"6913\" data-end=\"7078\"><strong data-start=\"6913\" data-end=\"6986\">Why do parents feel entitled to physically discipline their children?<\/strong> <strong data-start=\"6987\" data-end=\"7031\">Why do employers mistreat their workers?<\/strong><strong data-start=\"7032\" data-end=\"7078\">Why do governments oppress their citizens?<\/strong><\/p>\n<p data-start=\"7080\" data-end=\"7204\">Torture and <strong data-start=\"7092\" data-end=\"7133\">degrading treatment remain widespread<\/strong> in many countries, even those that <strong data-start=\"7169\" data-end=\"7203\">claim to champion human rights<\/strong>.<\/p>\n<p data-start=\"7206\" data-end=\"7417\">One of the most infamous examples is <strong data-start=\"7243\" data-end=\"7317\">the torture and abuse of prisoners in Abu Ghraib (Iraq) by U.S. forces<\/strong>. Similarly, detainees in <strong data-start=\"7343\" data-end=\"7361\">Guantanamo Bay<\/strong> were subjected to <strong data-start=\"7380\" data-end=\"7416\">horrific human rights violations<\/strong>.<\/p>\n<p data-start=\"7419\" data-end=\"7554\">These practices <strong data-start=\"7435\" data-end=\"7453\">continue today<\/strong>, often in secret. The <strong data-start=\"7476\" data-end=\"7553\">West condemns torture publicly but still practices it behind closed doors<\/strong>.<\/p>\n<p data-start=\"7556\" data-end=\"7669\">Torture is not limited to war zones\u2014it also <strong data-start=\"7600\" data-end=\"7668\">exists in detention centers, prisons, workplaces, and even homes<\/strong>.<\/p>\n<p data-start=\"7671\" data-end=\"7768\">Despite being outlawed, torture remains a <strong data-start=\"7713\" data-end=\"7767\">hidden reality in many so-called civilized nations<\/strong>.<\/p>\n<blockquote>\n<p data-start=\"93\" data-end=\"142\"><strong data-start=\"97\" data-end=\"142\">Article 6: The Right to Legal Recognition<\/strong><\/p>\n<p data-start=\"143\" data-end=\"225\"><strong data-start=\"143\" data-end=\"225\">&#8220;Everyone has the right to recognition everywhere as a person before the law.&#8221;<\/strong><\/p>\n<\/blockquote>\n<p data-start=\"227\" data-end=\"501\">Many people may <strong data-start=\"243\" data-end=\"267\">not fully understand<\/strong> the meaning of this right. In the past, <strong data-start=\"308\" data-end=\"340\">slaves had no legal identity<\/strong>\u2014they were not considered <strong data-start=\"366\" data-end=\"377\">persons<\/strong> but rather <strong data-start=\"389\" data-end=\"401\">property<\/strong>. Today, <strong data-start=\"410\" data-end=\"444\">everyone is legally recognized<\/strong>, but does that mean they have <strong data-start=\"475\" data-end=\"501\">full legal protection?<\/strong><\/p>\n<p data-start=\"503\" data-end=\"739\">In many <strong data-start=\"511\" data-end=\"548\">countries with oppressive regimes<\/strong>, people can <strong data-start=\"561\" data-end=\"603\">be stripped of their legal recognition<\/strong>, making them <strong data-start=\"617\" data-end=\"630\">stateless<\/strong>. data-start=\"3567\" data-end=\"3635\">Social security systems are nonexistent or severely underfunded.<\/strong><\/li>\n<li data-start=\"3638\" data-end=\"3714\"><strong data-start=\"3640\"
