The Arabic word used to denote adultery is <strong data-start=\"199\" data-end=\"209\">&#8220;<a href=\"https:\/\/en.wikipedia.org\/wiki\/Zina\" target=\"_blank\" rel=\"noopener\">Zina<\/a>&#8220;<\/strong>, which literally refers to sexual relations outside of marriage. Meanwhile, rape is indicated by the words <strong data-start=\"317\" data-end=\"328\">&#8220;Ikrah&#8221;<\/strong> (coercion) or <strong data-start=\"343\" data-end=\"357\">&#8220;Ightisab&#8221;<\/strong>, which imply forcing a woman into sexual intercourse through violence. Below, we will examine what Islam says about this issue without delving into excessive detail.<\/p>\n<h3 data-start=\"525\" data-end=\"566\"><strong data-start=\"529\" data-end=\"566\">Marital Rape and Slavery in Islam<\/strong><\/h3>\n<p data-start=\"567\" data-end=\"1076\">First and foremost, it is important to understand that Islam does not consider <strong data-start=\"646\" data-end=\"662\">marital rape<\/strong> or the <strong data-start=\"670\" data-end=\"695\">rape of a slave woman<\/strong>to be forbidden acts. A man has <strong data-start=\"728\" data-end=\"747\">absolute rights<\/strong> over his wife as well as over his female slaves, including <strong data-start=\"807\" data-end=\"824\">sexual rights<\/strong>\u2014this is referred to as <strong data-start=\"848\" data-end=\"867\">&#8220;Haq Al-Firash&#8221;<\/strong> (right to the bed). A wife must simply obey her husband, and a slave must obey her master, without any right to object. As you can see, this concept violates <strong data-start=\"1026\" data-end=\"1042\">human rights<\/strong>, particularly <strong data-start=\"1057\" data-end=\"1075\">women\u2019s rights<\/strong>.<\/p>\n<h3 data-start=\"1078\" data-end=\"1122\"><strong data-start=\"1082\" data-end=\"1122\">Islamic Rulings on Rape and Adultery<\/strong><\/h3>\n<p data-start=\"1123\" data-end=\"1708\">In <strong data-start=\"1126\" data-end=\"1145\">&#8220;Muwatta Malik&#8221;<\/strong>, a collection of legal rulings by Imam Malik, a distinction is made between two cases of rape. If the raped woman is <strong data-start=\"1263\" data-end=\"1278\">not a slave<\/strong>, then the rapist must pay her <strong data-start=\"1309\" data-end=\"1320\">a dowry<\/strong> (<em data-start=\"1322\" data-end=\"1328\">mahr<\/em>). If the rapist is married, his punishment (<em data-start=\"1373\" data-end=\"1380\">hudud<\/em>) is <strong data-start=\"1385\" data-end=\"1405\">stoning to death<\/strong>; if he is unmarried, he receives <strong data-start=\"1439\" data-end=\"1453\">100 lashes<\/strong>. This ruling is shared by scholars such as <strong data-start=\"1497\" data-end=\"1545\">Shafi\u2019i, Al-Layth, Abu Hanifa, and Al-Thawri<\/strong>. However, all of them cite a narration from <strong data-start=\"1590\" data-end=\"1611\">Ali Ibn Abi Talib<\/strong>, stating that <strong data-start=\"1626\" data-end=\"1707\">only the &#8220;hudud&#8221; (punishment) should be applied, without a compensatory dowry<\/strong>.<\/p>\n<p data-start=\"1710\" data-end=\"2238\">Imam Malik leans towards the first opinion because he distinguishes between <strong data-start=\"1786\" data-end=\"1803\">divine rights<\/strong>, which translate into <strong data-start=\"1826\" data-end=\"1855\">hudud (Islamic penalties)<\/strong>, and <strong data-start=\"1861\" data-end=\"1877\">human rights<\/strong>, represented by the dowry. To justify his position, he compares it to <strong data-start=\"1948\" data-end=\"1957\">theft<\/strong>: a thief\u2019s <strong data-start=\"1969\" data-end=\"2013\">hand is cut off to fulfill God\u2019s justice<\/strong>, but he is also required to <strong data-start=\"2042\" data-end=\"2072\">return the stolen property<\/strong> to ensure justice for the victim. Furthermore, <strong data-start=\"2120\" data-end=\"2152\">Malik does not differentiate<\/strong> between a <strong data-start=\"2163\" data-end=\"2237\">Muslim and a non-Muslim woman, or between a married woman and a virgin<\/strong>.<\/p>\n<p data-start=\"2240\" data-end=\"2619\">However, if <strong data-start=\"2252\" data-end=\"2284\">only penetration by a finger<\/strong> occurs, causing <strong data-start=\"2301\" data-end=\"2320\">hymenal rupture<\/strong>, Ibn Al-Muazzi cites <strong data-start=\"2342\" data-end=\"2372\">Ibn Zayd and Ibn Al-Kadhim<\/strong>, who suggest that <strong data-start=\"2391\" data-end=\"2435\">the dowry should be reduced to one-third<\/strong>, regardless of the woman&#8217;s age or whether the raped person is a slave. The rationale behind this ruling is that the injury is <strong data-start=\"2562\" data-end=\"2618\">classified as a wound rather than actual penetration<\/strong>.<\/p>\n<h3 data-start=\"2621\" data-end=\"2662\"><strong data-start=\"2625\" data-end=\"2662\">Excerpt from &#8220;Fatwa Encyclopedia&#8221;<\/strong><\/h3>\n<p data-start=\"2663\" data-end=\"2760\"><strong data-start=\"2663\" data-end=\"2760\">Question: What is the difference between adultery and rape from an Islamic legal perspective?<\/strong><\/p>\n<p data-start=\"2762\" data-end=\"3037\">According to <strong data-start=\"2775\" data-end=\"2790\">Islamic law<\/strong>, adultery that <strong data-start=\"2806\" data-end=\"2835\">merits punishment (hudud)<\/strong> is an act where <strong data-start=\"2852\" data-end=\"2909\">clear penetration of the penis into the vagina occurs<\/strong> outside of <strong data-start=\"2921\" data-end=\"2940\">lawful marriage<\/strong>, involving <strong data-start=\"2952\" data-end=\"3035\">two adults who are mentally competent and fully aware that the act is forbidden<\/strong>.<\/p>\n<ul data-start=\"3039\" data-end=\"3331\">\n<li data-start=\"3039\" data-end=\"3181\"><strong data-start=\"3041\" data-end=\"3070\">For unmarried individuals<\/strong>, according to <strong data-start=\"3085\" data-end=\"3106\">Ahmad and Shafi\u2019i<\/strong>, both <strong data-start=\"3113\" data-end=\"3149\">man and woman receive 100 lashes<\/strong> and are <strong data-start=\"3158\" data-end=\"3179\">exiled for a year<\/strong>.<\/li>\n<li data-start=\"3182\" data-end=\"3263\"><strong data-start=\"3184\" data-end=\"3207\">Malik and Al-Awza\u2019i<\/strong> agree but state that <strong data-start=\"3229\" data-end=\"3262\">only the man should be exiled<\/strong>.<\/li>\n<li data-start=\"3264\" data-end=\"3331\"><strong data-start=\"3266\" data-end=\"3280\">Abu Hanifa<\/strong> leaves the decision to the <strong data-start=\"3308\" data-end=\"3330\">judge\u2019s discretion<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"3333\" data-end=\"3516\">If one of the involved parties is <strong data-start=\"3367\" data-end=\"3378\">married<\/strong>, the punishment is <strong data-start=\"3398\" data-end=\"3418\">stoning to death<\/strong>. However, <strong data-start=\"3429\" data-end=\"3451\">Ibn Hazm and Ishaq<\/strong> argue that <strong data-start=\"3463\" data-end=\"3515\">100 lashes should be administered before stoning<\/strong>.<\/p>\n<h3 data-start=\"3518\" data-end=\"3546\"><strong data-start=\"3522\" data-end=\"3546\">Islamic View on Rape<\/strong><\/h3>\n<p data-start=\"3547\" data-end=\"3671\"><strong data-start=\"3547\" data-end=\"3555\">Rape<\/strong>, defined as <strong data-start=\"3568\" data-end=\"3621\">forcing a woman to engage in unlawful intercourse<\/strong>, follows a different ruling regarding the victim:<\/p>\n<ul data-start=\"3673\" data-end=\"3897\">\n<li data-start=\"3673\" data-end=\"3800\"><strong data-start=\"3675\" data-end=\"3690\">Ibn Qudamah<\/strong>, in <em data-start=\"3695\" data-end=\"3706\">Al-Mughni<\/em>, states: <strong data-start=\"3716\" data-end=\"3759\">&#8220;The victim is exempt from punishment,&#8221;<\/strong> a view agreed upon by Islamic scholars.<\/li>\n<li data-start=\"3801\" data-end=\"3897\"><strong data-start=\"3803\" data-end=\"3864\">If the rape is committed by force or under verbal threats<\/strong>, the victim <strong data-start=\"3877\" data-end=\"3896\">is not punished<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"3899\" data-end=\"3918\">For the <strong data-start=\"3907\" data-end=\"3917\">rapist<\/strong>:<\/p>\n<ul data-start=\"3919\" data-end=\"4095\">\n<li data-start=\"3919\" data-end=\"3963\">If <strong data-start=\"3924\" data-end=\"3935\">married<\/strong>, he is <strong data-start=\"3943\" data-end=\"3962\">stoned to death<\/strong>.<\/li>\n<li data-start=\"3964\" data-end=\"4002\">If <strong data-start=\"3969\" data-end=\"3982\">unmarried<\/strong>, he is <strong data-start=\"3990\" data-end=\"4001\">whipped<\/strong>.<\/li>\n<li data-start=\"4003\" data-end=\"4095\"><strong data-start=\"4005\" data-end=\"4037\">Shafi\u2019i, Malik, and Al-Layth<\/strong> also <strong data-start=\"4043\" data-end=\"4094\">require the rapist to pay a dowry to the victim<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"4097\" data-end=\"4315\">Shafi\u2019i states in <em data-start=\"4115\" data-end=\"4129\">Kitab Al-Umm<\/em>: <strong data-start=\"4131\" data-end=\"4315\">&#8220;The rapist must pay a dowry to the woman or the enslaved victim. The victim is not punished. The rapist, if married, is stoned; if unmarried, he is whipped and exiled for a year.&#8221;<\/strong><\/p>\n<h3 data-start=\"4317\" data-end=\"4365\"><strong data-start=\"4321\" data-end=\"4365\">The Danger of Islamic Law Regarding Rape<\/strong><\/h3>\n<p data-start=\"4366\" data-end=\"4691\">Islamic law clearly does not differentiate <strong data-start=\"4409\" data-end=\"4438\">between adultery and rape<\/strong> in terms of <strong data-start=\"4451\" data-end=\"4485\">punishment for the perpetrator<\/strong>. However, for the <strong data-start=\"4504\" data-end=\"4514\">victim<\/strong>, she is not punished in cases of <strong data-start=\"4548\" data-end=\"4556\">rape<\/strong>, and in the best-case scenario, she <strong data-start=\"4593\" data-end=\"4636\">receives financial compensation (dowry)<\/strong>, <strong data-start=\"4638\" data-end=\"4690\">which varies based on Islamic schools of thought<\/strong>.<\/p>\n<p data-start=\"4693\" data-end=\"4902\">At first glance, this <strong data-start=\"4715\" data-end=\"4740\">may appear to be just<\/strong>, but caution is needed: <strong data-start=\"4765\" data-end=\"4816\">Sharia law poses severe dangers to rape victims<\/strong>, especially because <strong data-start=\"4837\" data-end=\"4901\">Islam only recognizes rape or adultery if penetration occurs<\/strong>.<\/p>\n<p data-start=\"4904\" data-end=\"5236\">Additionally, <strong data-start=\"4918\" data-end=\"5006\">Islam does not distinguish between rape involving adults and that involving children<\/strong>. The primary concern for <strong data-start=\"5032\" data-end=\"5057\">Islamic jurisprudence<\/strong> is whether <strong data-start=\"5069\" data-end=\"5102\">the rapist was married or not<\/strong>, without any regard for the <strong data-start=\"5131\" data-end=\"5165\">age or condition of the victim<\/strong>. In this view, <strong data-start=\"5181\" data-end=\"5235\">rape is considered merely another form of adultery<\/strong>.<\/p>\n<h3 data-start=\"5238\" data-end=\"5291\"><strong data-start=\"5242\" data-end=\"5291\">The Dark Reality of Rape in Islamic Countries<\/strong><\/h3>\n<p data-start=\"5292\" data-end=\"5481\">Even today, in most <strong data-start=\"5312\" data-end=\"5341\">Muslim-majority countries<\/strong>, including those <strong data-start=\"5359\" data-end=\"5391\">not applying full Sharia law<\/strong>, rapists are often <strong data-start=\"5411\" data-end=\"5479\">offered the choice between imprisonment or marrying their victim<\/strong>!<\/p>\n<p data-start=\"5483\" data-end=\"5528\">For the victim, the options are equally grim:<\/p>\n<ul data-start=\"5529\" data-end=\"5702\">\n<li data-start=\"5529\" data-end=\"5606\"><strong data-start=\"5531\" data-end=\"5551\">Marry her rapist<\/strong>, live a life of suffering, and &#8220;restore family honor.&#8221;<\/li>\n<li data-start=\"5607\" data-end=\"5702\"><strong data-start=\"5609\" data-end=\"5632\">Refuse to marry him<\/strong>, but then <strong data-start=\"5643\" data-end=\"5670\">risk lifelong rejection<\/strong>, as <strong data-start=\"5675\" data-end=\"5701\">no man would marry her<\/strong>.<\/li>\n<\/ul>\n<p data-start=\"5704\" data-end=\"5854\">In <strong data-start=\"5707\" data-end=\"5728\">Islamic societies<\/strong>, a <strong data-start=\"5732\" data-end=\"5784\">rape victim is often viewed as a source of shame<\/strong>, bringing <strong data-start=\"5795\" data-end=\"5853\">dishonor to her family, her community, and her country<\/strong>.<\/p>\n<h3 data-start=\"5856\" data-end=\"5910\"><strong data-start=\"5860\" data-end=\"5910\">Victim-Blaming in Patriarchal Islamic Cultures<\/strong><\/h3>\n<p data-start=\"5911\" data-end=\"6047\">As is common in <strong data-start=\"5927\" data-end=\"5954\">male-dominated cultures<\/strong>, <strong data-start=\"5956\" data-end=\"5998\">women\u2014 even when raped\u2014 bear the blame<\/strong>. Many Muslims believe the victim was at fault:<\/p>\n<blockquote data-start=\"6048\" data-end=\"6106\">\n<p data-start=\"6050\" data-end=\"6106\">&#8220;After all, she must have done something to provoke it.&#8221;<\/p>\n<\/blockquote>\n<p data-start=\"6108\" data-end=\"6231\">As a result, many rape victims <strong data-start=\"6139\" data-end=\"6166\">accept forced marriages<\/strong> just to <strong data-start=\"6175\" data-end=\"6193\">avoid disgrace<\/strong> and <strong data-start=\"6198\" data-end=\"6230\">reclaim their family&#8217;s honor<\/strong>.<\/p>\n<h3 data-start=\"6233\" data-end=\"6286\"><strong data-start=\"6237\" data-end=\"6286\">The Failure of Scholars to Address This Issue<\/strong><\/h3>\n<p data-start=\"6287\" data-end=\"6501\">Despite the <strong data-start=\"6299\" data-end=\"6344\">outrageous injustice of Islamic rape laws<\/strong>, <strong data-start=\"6346\" data-end=\"6405\">Western and Arab intellectuals rarely address the issue<\/strong>.
